A supplementary affidavit challenging the lawfulness of the approval of building plans for the development of a R250 million shopping centre, anchored by Shoprite Checkers on Ladies Mile Road, in Constantia, came before the High Court on Monday February 18 and Tuesday February 19.
Submissions were made by Advocate Sean Rosenberg on behalf of the Constantia Residents’ and Ratepayers’ Association (CRRA), Advocate Geoff Budlender for the City (first respondent) and Advocate Andrew Breitenbach for the landowners, Hadjie Abdullah Solomon Family Trust and Hadjie Ismael Solomon Family Trust (“Legal dispute over development”, Bulletin, January 31).
The judge said that he would make his findings and decision as soon as possible but gave no indication when this would be.
